These Terms of Use ("Terms") govern your access to and use of our website, mobile application, and matchmaking services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
2. Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. You must be genuinely seeking a marriage partner and not currently married at the time of registration. SunjoKia EverAfter reserves the right to verify your eligibility at any time and to refuse service to anyone who does not meet these requirements.
3. Account Registration
To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process, including during the onboarding and vetting stages. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, outdated, or incomplete.
4. User Conduct
You agree not to use the Service to: (a) upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable; (b) impersonate any person or entity or misrepresent your affiliation with any person or entity; (c) engage in any form of harassment, stalking, or intimidation of other users; (d) use the Service for any commercial purpose without our prior written consent; (e) collect or store personal data about other users without their consent; (f) interfere with or disrupt the Service or servers connected to the Service; (g) provide false or misleading information in your profile or during the vetting process.
5. Matchmaking Service
SunjoKia EverAfter is a human-led matchmaking service. We do not guarantee that you will find a match or that any match will lead to a successful relationship or marriage. Our team personally reviews profiles and makes match recommendations based on the information you provide and our professional judgment. Match recommendations are suggestions only; you are solely responsible for deciding whether to pursue any introduction. We are not responsible for the conduct, behavior, or representations of any user, whether online or offline.
6. Payment and Fees
Certain features of the Service require payment. By subscribing to a paid plan, you agree to pay all applicable fees as described at the time of purchase. All payments are processed through our third-party payment provider (Stripe). Fees are non-refundable except as expressly stated in our refund policy or as required by applicable law. We reserve the right to change our fees at any time, with notice provided to active subscribers before any fee increase takes effect.
7. Privacy
Your privacy is important to us. Our Privacy Policy, available separately on our website, describes how we collect, use, and share information about you. By using the Service, you consent to our collection, use, and sharing of your information as described in our Privacy Policy. Profile anonymization measures (such as profile codes) are used to protect your identity during the initial stages of the matching process.
8. Intellectual Property
The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of SunjoKia EverAfter and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent. You retain ownership of any content you submit, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content solely for the purpose of providing and improving the Service.
9. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will cease immediately. You may terminate your account at any time by contacting us or through the account settings. Upon termination, we will delete your profile and personal information in accordance with our Privacy Policy, subject to any legal retention requirements.
10. Limitation of Liability
In no event shall SunjoKia EverAfter, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; (d) unauthorized access, use, or alteration of your transmissions or content; or (e) any interactions between you and other users, whether online or offline.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the federal or state courts located in Harris County, Texas. You agree to submit to the personal jurisdiction of such courts.
12. Changes to Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised Terms.
